The EU has approved new rules for work and leisure for truckers. According to the old rules, truckers were entitled to at least 45 hours of rest after a maximum of 6 days of work, and in addition, there was an abridged option - at least 24 hours of rest, but with subsequent compensation for those hours of rest that were not reached in the previous period .. Now the scheme will be more flexible. It will be possible to rest for two short periods in a row, but provided that there will be no more than two during each four-week period. But the compensated rest time should be provided to the driver completely until the end of the third week after a shortened rest.
It is also possible to have a short rest in the truck cab, and a long rest is possible only in the room paid by the employer - with a bed and a bathroom, as well as taking into account the gender of the driver. In addition, the company must give the driver the opportunity to spend at least one weekly rest for every 4 weeks of work at home.
In addition, for the comfort of drivers, a network of certified parking lots will be created with protection from unauthorized persons, with the sale of food and drinks, good lighting and bathrooms, taking into account gender. Their list will be published on a special site.
Under the new rules, drivers who come to a foreign country will also need to be registered as business travelers and thus pay them the salary accepted in the country in which they enter. For rich countries - it will be more. Exceptions will be made by drivers traveling in transit or making bilateral traffic - between the country where their company is registered and another country. In this case, it is allowed to perform up to two unloading / loading operations, but only one in each country that the truck passes so that the cars do not drive empty.
The rules will come into force in a year and a half.
These innovations should put an end to the practice when firms from poor countries are engaged in transportation to rich countries of the European Union. Now companies will need to create offices with personnel and a fleet of cars, as well as pay taxes where they actually work. To such offices in the countries where services are provided, truck drivers must be assigned.
In this way, systematic cabotage (domestic transportation of goods in one country by carriers from another EU country) will be eliminated, since drivers will need to be sent. The current restrictions on cabotage will remain: no more than 3 operations in 7 days, after which the truck does not have the right to enter the same country for only 4 days, but is forced to return to the country of registration.
To control the innovations, smart tachographs will be introduced that register border crossings between EU countries in the satellite navigation system. They will be equipped with all trucks until the end of 2023, and in July 2026 - and cars with a maximum permissible weight of more than 2.5 tons.
At the same time, working conditions in the European Union for drivers from Russia, Ukraine and Belarus are regulated by the European Agreement for crews of vehicles engaged in international road transport, which will remain in force.
At the same time, the new rules state that firms registered outside the EU cannot receive more favorable conditions than firms of the European Union itself, which means that Russian, Ukrainian and Belarusian truckers will earn more in the EU. To do this, Brussels must begin negotiations with the AETR member states.
