The property of the spouses in Russia will be divided according to the new rules

The State Duma adopted in the first reading a bill that changes the rules for the division of property of a married couple which filed for the divorce.

In particular, it is proposed to amend the Family Code, which will allow after the divorce to divide both movable and immovable property, including non-cash funds, securities, shares in companies, as well as debts of spouses.

“It is proposed to consider the common property of the spouses as the totality of all the“ assets ”and“ liabilities ”acquired in the marriage”, - writes legal.report with reference to the words of the co-author of the initiative, the chairman of the Committee on State Building and Legislation Pavel Krasheninnikov.

The new bill, in particular, prohibits splitting a controlling stake in one company, as well as sharing the rights to those facilities whose value may decrease as a result of such a division. The bill proposes to give such assets to one of the spouses, proportionally subtracting their value from the share due to him when dividing the property. If the value of one of the indivisible objects is higher than the whole share of the spouse, then the second is invited to pay monetary compensation.

If the purchase of an object during the marriage becomes known after the divorce, then the second spouse will even be able to demand his share in it.

In addition, the bill proposes to limit the number of cases when a prenuptial agreement can be declared null and void. In the event of bankruptcy of one of the spouses, it is proposed to first allocate a share of the second in the total property, and only after that debt collection is possible. Spouses will also be able to file for bankruptcy together if they have common debts.

Earlier, the Federal State Statistics Service calculated how long the marriage of Russians lasted. The statistical service found that most Russians seek to get married before the age of 30. A third of all marriages occur in newlyweds between the ages of 25 and 29. But Russians get divorced most often between the ages of 30 and 34. For every 100 marriages, there are 65 divorces. Almost a third of Russians leave after they have lived together from five to nine years, another 13% are divorced after ten years of marriage.
