The court did not cancel the fine for the Bashkir media, which published a video of the beating of a child

Let us recall you that in the summer, UfaTime published a video in which parents beat the child in front of passers-by. After the release of the material, the Prosecutor General's Office of the Russian Federation became interested in the incident. And Roskomnadzor demanded parents' permission from journalists to publish the video. At the same time, it was impossible to identify on the footage what kind of boy it was. And how was it possible to get the permission from the parents, who hit the child themselves?

When publishing the video, the editors considered that due to the poor quality, it was impossible to identify the child. However, Roskomnadzor came to a different conclusion and drew up three protocols at once: for the enterprise, the director and the editor-in-chief. The Magistrate's Court satisfied the department's demands. In this connection, an appeal was filed with a higher court.

During the examination of the complaint, representatives of UfaTime demonstrated the opinion of an independent forensic expert, which stated that the quality of the video and audio did not allow identifying the child. Therefore, there are no grounds for punishing the media, the expert said.

However, representatives of the department did not come empty-handed either. Roskomnadzor (Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications) presented the court with an “express opinion” from a subordinate organization, which, in turn, came to the conclusion that the child can be identified.

UfaTime.ru asked the court to appoint a forensic examination that would answer the questions of both parties. However, the request was not granted. The Court of Appeal also sided with Roskomnadzor (Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications).

Lawyer Roman Petrov considers the decision of the Kirovsky District Court unfair, since the court did not take into account the opinion of the independent expert. According to him, the ruling is subject to appeal at the Sixth General Jurisdiction Court of Cassation in Samara.

In addition, the Bashkir newspaper was denied an extension of the term for paying the administrative fine to 180 days. “The company is a small business entity, it has 13 employees, the director and founders of the company took out a loan in connection with a covid situation. Therefore, we consider the refusal to be absolutely unreasonable - it puts society on the brink of bankruptcy. I think this is unfair, also because individuals with their extenuating circumstances are also involved in the case", - Petrov said.

Director of LLC "Ufataim" Roman Sadykbaev stressed that the position of the media remains unchanged. “An independent examination proves our correctness. Situations involving the life and health of the child should be brought up for public discussion. And the media, in turn, should not ignore cases of cruelty towards children for fear of being unjustifiably punished”, - he said.
