Tinkoff Bank was fined for frequent inquiries of the client's credit history

The Mariinsky City Court of the Kemerovo Region determined that Tinkoff Bank JSC should pay compensation for moral damage for the fact that it, without the consent of the citizen, requested reports on his loans from the credit bureau.

A resident of Mariinsk, Aleksey Balashov, applied to the court with a claim to recover moral damage from the bank. The court found that between 2016 and 2019, the bank requested the plaintiff's credit history more than ten times. This was evidenced by the queries "account view", "consumer credit" and "credit card".

In October 2019, Balashov found out about this and turned to the Service for the Protection of Consumer Rights and Ensuring the Availability of Financial Services of the Bank of Russia.

The check showed Balashov was right. Tinkoff Bank replied that such requests were made solely due to technical failures.

Nevertheless, in the actions of the bank, the structure of an administrative offense was established in accordance with Article 14.29 of the Administrative Code. As a result, the bank was fined 30 thousand rubles, and Balashov was awarded compensation for moral damage in the amount of 5 thousand rubles. At the same time, the plaintiff himself assessed the moral damage inflicted on him at the rate of 47,500 rubles. However, the court reduced this amount.

It's worth to note that earlier "Tinkoff Bank" tried to collect a debt from a resident of Mariinsk under a loan agreement, despite the previous court rejection of the claim.
