The grounds for the suspension of an employee from work due to compulsory vaccination in the region specified by Rostrud say that remote workers are not exempt from the requirement to be vaccinated, and their transfer to a remote format is not an alternative to suspension.

Rostrud indicated that it is possible to return an employee to the workplace only when he is vaccinated or after the end of the coronavirus pandemic.

The Association of NK "Association of Corporate Lawyers", where Rostrud sent a letter with clarifications, declined to comment and said that "there are more questions than answers", Izvestia reports.

The date of the employee's suspension depends on the duration of the vaccination in the constituent entity of the Russian Federation. Moscow will be the first - in the city 60% of workers in trade, catering and other industries must be vaccinated with the first component by July 15, and the second by August 15. The employee must provide the employer with a certificate of vaccination or a medical evacuation.

Earlier, Rostrud substantiated the legality of the removal of unvaccinated employees from work. The department indicates that, according to part 1 of Art. 76 of the Labor Code of the Russian Federation, it is possible to remove an employee from performing labor duties in cases not only provided for by the Labor Code and federal laws, but also by other regulatory legal acts, for example, the law "On immunization of infectious diseases".
