The man claims that the image inflicted irreparable psychological trauma on him, and accuses those involved in creating the cover of the sexual exploitation of children.

Spencer Elden, the same baby whose photo graces the cover of the cult album recorded by Kurt Cobain's band in 1991, has filed a lawsuit against everyone involved in its creation, according to Pitchfork. Elden believes he has been a victim of child sexual exploitation and is seeking compensation. Defendants include photographer Kirk Weddle, live band members, Kurt Cobain's heirs and several labels behind the album: DGC Records, Warner Records, MCA Records and Universal Music Group.

According to Elden, he and his parents did not sign an agreement that would allow the use of his image, and did not receive any compensation for this. At the same time, a nude photo on one of the most recognizable music covers of all times and peoples brought him lifelong psychological and material problems. Among the damages, the lawsuit mentions not only permanent emotional distress, but “loss of past and future wages, past and future costs of medical and psychological treatment, loss of pleasure in life and other losses”. Elden is seeking compensation for his own damages, attorney fees, and a restraining order for all parties to "continue to engage in illegal activities".

Elden got on the cover because his father was a friend of the photographer Kirk Weddle, who once offered to photograph the child for $ 200. Five years ago, giving an interview to GQ Australia magazine, Elden admitted that before he was proud of his involvement in the famous record - he even had a Nevermind tattoo on his chest - but recently his attitude has changed: “I keep thinking:“ What if I wouldn't give a damn about the fact that my fucking penis was seen by everyone around?" But I had no choice".
