In March 2021, the National Labor Relations Board, after several trials, seemed to put an end to Musk's fight against unions after Tesla fired activist Richard Ortiz, who tried to create a union at an electric car assembly plant.

The council decided to reinstate him at work, and also ordered Musk to delete his tweets attacking unions. Tesla will have to renegotiate employee confidentiality agreements, as labor laws "protect employees when they talk to the media about working conditions, labor disputes or other terms of employment (not trade secrets).

Experts believe that these measures will finally introduce Tesla into the market economy, making it clear to Musk that federal preferences are ending.
