According to the resolution of the Board of Administrative Offenses of the Supreme Court of the Russian Federation, in cases of violation of the mask regime, it is possible not to carry out investigations and examinations - a protocol drawn up and photographic recording of the violation is enough.

The cassation appeal of a grocery store from the Moscow district of Lyublino, fined 100 thousand rubles for a seller without a mask, became a precedent. A representative of the store disagreed with the decision and continued to challenge it, right up to the Supreme Court. The complaint stated that the district court did not order an expert examination of the photograph and did not question the attesting witnesses. According to RIA Novosti, the Supreme Court agreed with the opinion of the district court, noting that "special knowledge in science and technology" is not required to establish guilt in this case.

"The photographic material on which the shop assistant is recorded at his workplace in the trading floor without personal protective equipment for the respiratory organs (masks, respirators) is reasonably recognized by the courts as reliable and admissible evidence in a case that meets the requirements for this type of evidence by the named code", - says the resolution.

The court noted that there is no need for an administrative investigation either, because it "is carried out only in cases where an expert examination or other time-consuming procedural actions are carried out".

Earlier it was reported that the Supreme Court of Russia considered the refusal of a citizen to wear a protective mask in a public place during the coronavirus pandemic as a significant violation.
