The court punished the draft dodger with a fine of 10 thousand rubles

In Kuzbass, a sentence was passed against a 23-year-old defendant accused of evading military service.

Danil Lukyanov, who has been on the federal wanted list for more than two and a half years, having repented of his deed, in early March he himselfcame to court to continue consideration of the criminal case against him for the crime provided for in part one of Article 328 of the Criminal Code of the Russian Federation (evasion of conscription for military service ).

The criminal case against Danil Lukyanov was received by the Mariinsky City Court of the Kemerovo Region back in April 2019. As it turned out, the defendant did not plan to appear in court, and on the eve of the court session scheduled for May 14, 2019, he received an appeal via the Internet, in which he claimed that he had not given written consent to the notification in any way to anyone.

The court repeatedly made various attempts to inform the defendant about the hearings, which did not give a positive result, in connection with which the court concluded that the defendant Lukyanov had fled.

As a result, by a decision dated June 13, 2019, the court suspended the criminal proceedings, instructing the prosecutor of the city of Mariinsk to ensure the search for the defendant.

It should be noted that while on the federal wanted list, the defendant repeatedly sent various appeals to the court via the Internet, demanding to stop summoning him to court, and also demanding to stop the criminal case (in one of his last appeals, the defendants were even given the condition that that in case of refusal to terminate his criminal case, all the persons involved will owe him “monetary energy in the amount of $1,000,000”).

Also, during the unsuccessful search by the prosecution authorities, it was repeatedly reported to the court about the active use of social networks by Lukyanov.

However, two and a half years later, the defendant himself appeared in court to continue the consideration of the criminal case against him. But in the middle of last year, a measure of restraint in the form of detention was already chosen “in absentia”, in connection with which the defendant was detained in the courthouse by invited employees of the internal affairs bodies, with whom he proceeded to the department of the Ministry of Internal Affairs of Russia in the Mariinsky district.

A few days later the criminal case was considered.

The defendant at the hearing explained that until 2018 he had a deferment from military service, because he was studying at a college. In October 2018, when the deferment ended, he was handed a summons several times, but he refused to receive it, and as a result, he actually foolishly avoided military draft. At present, he does not intend to evade the draft.

In the last word, the defendant fully admitted his guilt, repented of his deed and asked not to punish him severely.

Taking into account the absence of aggravating and the presence of a number of mitigating circumstances, the court sentenced Lukyanov to a fine of 10,000 rubles.

The verdict was not appealed and the other day came into force.
