The court qualified the case under part 1 due to the fact that the publication was made before the first arrest for 15 days. The defense announced its intention to appeal the decision of the court.

Gozman* was detained at the exit from the special detention center after serving the previous administrative arrest. It is noted that on the page of his blog in LiveJournal, he identified the actions of the NKVD and Smersh servicemen with the actions of Nazi Germany's Gestapo and SS units during the Second World War. The publication notes that the court rejected the petitions of lawyer Mikhail Biryukov to interrogate witnesses from among law enforcement officers and experts, but attached the convict's medical certificates to the case.
