"Today, the verdict in the Breusov case was left unchanged, it entered into legal force", - said Olga Andrusenko, a representative of the court, an assistant judge, in an interview with RIA Novosti.
She clarified that the defendant participated in the court session via video link from Petropavlovsk-Kamchatsky.
According to the publication, referring to representatives of the 35th garrison Military Court, Breusov was found guilty of non-execution of the order, and the appointed sentence did not enter into force and was appealed on appeal to the Pacific Naval Military Court. It was indicated that the serviceman "refused to comply with the order of the commander of the military unit and go to the zone of a special military operation." According to the court, the Statute of the Internal Service of the Armed Forces of the Russian Federation and the Disciplinary Statute of the Armed Forces of the Russian Federation were violated in this way.
The Pacific Naval Military Court told the publication that the mitigating circumstance was the surrender, and the aggravating one was the failure to execute an order during the mobilization period. The case was considered at a closed meeting in a special order.
