The liquidation of the "International Memorial"* meets the principle of proportionality and corresponds to the violations committed by the organization, the decision of the Supreme Court of Russia says.

According to Interfax, the court considered that the Prosecutor General's demand "on the application of an extreme measure of public liability in the form of liquidation of a public association is reasonable and complies with the principle of proportionality to the violations committed and the consequences they caused".

The Court came to this decision based on “the nature and number of violations committed by the Organization and their consequences, the repeated use of administrative pressure in accordance with the legislation of the Russian Federation on administrative offenses, which did not lead to the suppression of the Organization’s illegal actions and the elimination of their consequences, taking into account the exhaustion of funds state response, in order to protect the foundations of the constitutional order”.

The Supreme Court also stated that the organization's failure to comply with the requirements of the law regarding the procedure for registration, the requirements of the charter and the provisions of the law "On non-profit organizations" in relation to NCOs - foreign agents "violates the constitutional principle of equality of public associations, thereby encroaching on the foundations of the constitutional legal order." In court believe that "Memorial*" not only did not take all possible steps to eliminate the violations it committed, but "deliberately does not comply with the law," although "there are no objective obstacles to this".

Recall that in December last year, the Supreme Court of Russia, at the suit of the Prosecutor General's Office, ruled to liquidate this human rights organization. A similar decision was made by the Moscow City Court at the suit of the Moscow prosecutor's office. The decision to liquidate was made based on the fact that the organization, which was previously included in the register of foreign agents, violated the law on foreign agents more than once.

At the same time, in January, a group of Estonian deputies who support Russian oppositionists and political prisoners nominated the human rights "Memorial"* for the Nobel Peace Prize.
