Natalya Bereznaya of Tver, who in the spring of 2020 published a high-profile video on the state of one of the Tver hospitals on social networks, reported that the Investigative Committee of the Russian Federation refused to initiate a criminal case against her.

However, the misadventures of the truth-seeker did not end there.

Natalya Bereznaya published a detailed post on Facebook on this topic with attached documents. Let us recall how events developed. In April 2020, Natalia Bereznaya was hospitalized in Tver Hospital No. 6, where she recorded a video about not the best conditions of stay. The video was picked up by social networks and replicated by local media. Later, the media published notes that the information spread by Birches was not confirmed.

In relation to Natalya Bereznaya, a pre-investigation check was initiated on the possible fact of a crime under Art. 207.1 of the Criminal Code of the Russian Federation ("Public dissemination of knowingly false information about circumstances posing a threat to the life and safety of citizens"). The result of the check was the refusal to initiate a criminal case. Moreover, the investigator, in his decision to refuse to initiate a criminal case, indicated that the circumstances to which Natalya Bereznaya referred in her video were true.

However, the drafter of the decision on bringing to administrative responsibility Police Lieutenant Ionescu Maxim Vasilievich comes to the conclusion that Bereznaya “committed an offense under Art. 13.15 h. 9 of the Administrative Code of the Russian Federation ". This article deals with the abuse of freedom of speech; in particular, its ninth part refers to the dissemination "in the media, as well as in information and telecommunication networks of deliberately unreliable socially significant information under the guise of reliable messages ..."

It turns out that the New Year's “gift” from the Russian law enforcement system turned out to be sweet and sour: if the Investigative Committee believes that there is no corpus delicti in Natalia's actions, then the police still sees an administrative offense.
