RBC: The Ministry of Justice proposed to ban debt collection from residents of new regions for 3 years

The Ministry of Justice has taken the initiative to prohibit debt collection from residents of Donetsk and Lugansk People's Republics, Zaporozhye and Kherson regions. It is proposed to introduce a moratorium for a period of 3 years — until January 1, 2026. The text of the bill was reviewed by RBC.

"The bill proposes to establish a ban on the implementation of activities for the return of overdue debts of individuals in the territories of these entities," the explanatory note says (quoted by RBC).According to the text of the document, it is proposed to extend the ban to the debts of citizens to professional creditors — banks and microfinance organizations.

If the initiative is adopted, the moratorium will not apply to debts to individuals, debts on business loans and debts on housing and communal services."There is a transitional period until January 1, 2026, during which issues of integration of new entities into the economic, financial, credit and legal systems of the Russian Federation, into the system of state authorities of the Russian Federation are subject to settlement," a representative of the Ministry of Justice said in an interview with the publication.

The draft law was developed jointly with the concerned authorities.

It has already been agreed with the Ministry of Finance, the FSSP, as well as the state Legal Department of the President of the Russian Federation. The document has been submitted to the government.RBC drew attention to the fact that only one major Russian bank, Promsvyazbank, operates in these regions.

Also in the DPR there is a Central Republican Bank, in the LPR — the State Bank of the LPR, and in the DPR, LPR and Zaporozhye, since October, the Central Bank has also been operating, which announced plans to open a branch in the Kherson region. All of them offer lending programs to the population.According to Elman Mehdiyev, President of the National Association of Collection Agencies (NAPCA), the adoption of the bill without taking into account the interest of business may create additional difficulties, and Ekaterina Avdeeva, head of the expert center for criminal law policy and enforcement of judicial acts of Delovaya Rossiya, suggests that this may result in a decrease in financial activity.
