The recommendations sent by the Central Bank of the Russian Federation to credit institutions say how to track illegal money transfers

Experts suggest that the government is determined to close the gray business problem. On September 6, the Central Bank published "Methodological recommendations on increasing the attention of credit institutions to certain operations of individual clients", which, in particular, says that the operational identification of bank accounts of individuals, as well as electronic means of payment, which are registered in individuals persons and are used for settlements with other individuals, for which money transfer operations correspond to several criteria. So, what can your card be blocked for:

- more than 10 per day or more than 50 per month - the number of individual counterparties;

- more than 30 transactions per day performed by individuals;

- operations for crediting non-cash funds between individuals in the amount of more than 100 thousand rubles per day or 1 million rubles per month;

- a short period of time (one minute or less) between funds crediting and debiting;

operations for crediting and debiting funds, carried out within 12 hours of one day;

- the lack of payments in favor of legal entities that provide livelihoods (payment for utilities, communication services, goods);

- coincidence of identification information about the device used by different individuals for remote access to the bank's services;

- during the week, the average cash balance in the bank account is less than 10% of the average daily volume of transactions.

“All this should officially“ oppose ”the“ settlement of the shadow gambling business, ”explains economist Dmitry Prokofiev . individuals? Of course not. These measures are the foundation stone for the coming total cost control. "Every penny must be accounted for!"

Let's say payments between individuals are under attack today

Who prevents the regulator from setting restrictions on clothing purchases tomorrow? Or going to a restaurant?

No butter cards. There will simply not be a transaction - you have already bought a coat this season, why do you need two? You have already dined at a restaurant twice a month, why do you need a third? You have already refueled the car ... And so on. No, they will not even be banned, but simply bahn increased commissions for "over-consumption". (And the environmental agenda, again, on the same line. These commissions can be formalized as "collection for disposal", etc.). And do not say that you were not warned..."

Prokofiev lists the reasons for blocking:

- more than 10 per day or more than 50 per month - the number of individual counterparties;

- more than 30 transactions per day performed by individuals;

- transactions for crediting non-cash funds between individuals in the amount of more than 100 thousand rubles per day

“That is, there will be no more fees-to-card in a“ difficult life situation ”- they asked people for money - and people transferred it to you - this is the basis for blocking, if anything. Only "through the cashier," comments Prokofiev. - Yes, they want to block any unauthorized activities of people related to money. Or take tax from them, at best ... "

Experts believe that this is just the beginning, and they predict that the most unpleasant thing will not be fines and penalties, but the fact that it will be possible to get into the number of violators quite by accident. Here are a few more recommendations that the Central Bank gives if credit institutions identify the cases listed above:

- to ensure increased attention to the operations of such clients - individuals;

- to be guided in relation to such clients by the recommendations contained in letter No. 60-T4;

- consider the relevant transactions for suspicions that they are being carried out for the purpose of legalizing (laundering) proceeds of crime or financing terrorism and, if there are such suspicions, exercise the right to refuse to execute the client's order to carry out the transaction provided for in clause 11 Article 7 of Federal Law No. 115-FZ5;

- if two or more decisions are made during a calendar year to refuse to comply with the client's order to perform a transaction on the basis of clause 11 of Article 7 of Federal Law No. 115-FZ, consider the implementation of the right provided for in Clause 5.2 of Article 7 of Federal Law No. 115-FZ to terminate the bank account (deposit) agreement with the client.

In other words, if someone receives several transfers from different persons to his account, or, conversely, sends several transfers from his account to other people, then he may at first be deprived of the opportunity to carry out such operations, and then completely block the account and terminate with it contract. And after that, this person is included in the "black list" of persons with whom no one will work, and he will not be able to send or receive money.

According to experts, in order not to pay 7% of taxes, it makes no sense to take risks with such operations. Why make life difficult for ourselves?
